There are many states which have relaxed laws or have legalized marijuana for medicinal use, South Carolina is NOT one of them. A charge for possession of marijuana in South Carolina is a drug charge and a person is subject to prosecution. This charge can be a felony or a misdemeanor depending on the amount (weight) of drugs that is found in the vehicle or o the person of the defendant. This type of case is prosecuted in state court and carries up to 15 years in jail. A drug weight that is over 400 grams or many pounds or kilograms can result in a federal charge that can be listed as Trafficking in Marijuana. This type of case is prosecuted in the federal court and can result in up to 30 years in jail to a LIFE sentence for a major amount.
